1. Identity and scope
Everworks by Fluge is the public-facing name of Fluge's audio software and research project. It is not presented as a separate company. These Terms apply to everworks.dev, its product pages, documentation, account area, community features and downloads.
The responsible project and legal contact is Everworks by Fluge, based at C/ Sierra de Albarracín, 61, Pol. Ind. Las Monjas, Parque Empresarial A3, 28500 Arganda del Rey, Madrid, Spain.
By accessing or using the services, you agree to these Terms. If you download or install software, the Software License and any package-specific notice also apply. A package-specific signed agreement takes precedence for that package where it conflicts with these general Terms.
2. Access and accounts
Browsing public pages does not require an account. Some downloads, community actions or beta resources may require free registration and email verification.
- You must provide accurate information and keep your sign-in credentials confidential.
- You are responsible for activity carried out through your account unless you notify us promptly of unauthorised use.
- You must be at least 16 years old, or have the authorisation required by the law applicable to you.
- One person may not impersonate another person, company or Fluge representative.
Registration does not create an entitlement to a particular product, release schedule, support level or permanent availability.
3. Software, downloads and beta builds
Everworks software may include stable releases, public betas, research previews and host-specific builds. The status shown on the relevant product or download page forms part of the product information.
Downloads may be replaced, withdrawn or limited when a build is obsolete, unsafe, unlawfully redistributed or no longer supportable. You are responsible for checking format, operating-system, architecture, host and sample-rate compatibility before installation.
Software use is licensed, not sold. Free availability does not place the software, models, presets, artwork or documentation in the public domain.
4. Community content
When you submit a post, title, vote, suggestion or other material, you retain ownership of your content. You grant Everworks by Fluge a non-exclusive, worldwide, royalty-free licence to host, display, reproduce and moderate that content for operating and improving the community and products.
Community posts may be public. Do not include confidential production material, unreleased client information, passwords, personal data belonging to others or content you do not have permission to share.
We may remove spam, abuse, unlawful content, security disclosures that create immediate risk, misleading impersonation or material unrelated to the community. Repeated or serious breaches may lead to account restriction.
5. Acceptable use
You may not use the website or services to:
- break applicable law or infringe intellectual-property, privacy or contractual rights;
- probe, overload, bypass or interfere with authentication, download controls, hosting or security systems;
- upload malware, automate abusive traffic, scrape personal data or attempt unauthorised access;
- misrepresent an unofficial build as an Everworks by Fluge release;
- redistribute protected software except where the relevant licence expressly allows it.
Responsible vulnerability reports are welcome through the contact channel. Do not publish exploit details or access data beyond what is necessary to demonstrate the issue.
6. Intellectual property
The website, software, DSP code, trained models, model weights, kernels, presets, documentation, graphics, product names and logos are protected by intellectual-property and unfair-competition laws. Rights belong to their respective owners and licensors.
“Everworks by Fluge”, product names and associated visual identities may not be used to imply sponsorship, certification or affiliation without written permission. Rights in your own audio inputs and lawful production outputs remain yours, subject to third-party rights in the material you process.
7. Third-party services and links
The website may rely on third-party infrastructure for hosting, authentication, file delivery, fonts or external downloads. Third-party destinations operate under their own terms and privacy policies. A link does not guarantee continued availability or endorse unrelated content on that service.
Plugin formats, operating systems, DAWs and third-party product names are identified only for compatibility. Their owners do not sponsor Everworks by Fluge unless expressly stated.
8. Warranties and liability
To the maximum extent permitted by law, free and beta services are provided “as available” without a promise of uninterrupted operation, error-free processing or fitness for a specific live, safety-critical or commercial purpose.
Nothing in these Terms excludes liability that cannot legally be excluded, including liability for fraud, wilful misconduct or rights granted by mandatory consumer law. Subject to those limits, Everworks by Fluge is not responsible for indirect loss, lost sessions, lost income, unavailable third-party services or damage caused by unsupported configurations, failure to keep backups or use contrary to documentation.
9. Changes, suspension and termination
We may update the website, product range and these Terms to reflect technical, security, legal or operational changes. The effective date will identify the current version. Material changes will be communicated through a reasonable channel where required.
You may stop using the services at any time and may request account deletion under the Privacy Policy. We may suspend access where reasonably necessary to protect users, comply with law, investigate abuse or enforce these Terms.
10. Governing law and contact
These Terms are governed by Spanish law. Courts in Madrid, Spain, will have jurisdiction unless mandatory consumer law grants you the right to bring proceedings elsewhere.
